Digital Millennium Copyright Act (DMCA) Notice Procedure for FantasyCraft Market

Preface: This document sets forth the procedures instituted by FantasyCraft Community for receiving, reviewing, and addressing notifications of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512) (“DMCA”).

  1. Exclusive Channel of Communication: All DMCA notices ("Notices") and related correspondence must be delivered exclusively to our dedicated email at info@fantasycraftcommunity.com. Notices sent through any other medium, channel, or address will not be considered or responded to for the purpose of DMCA procedures. Any such communications received elsewhere shall, at our discretion, be redirected to our aforementioned dedicated email for appropriate action.

  2. Non-Obligation for Alternative Communication Channels: FantasyCraft Community retains the right to ignore, without liability, any DMCA-related communications received through channels other than the designated email. If, out of courtesy, any response is provided through an alternative channel, it will be to direct the communicator to our designated email for official correspondence.

  3. Response Time: While the DMCA provides service providers a window of time to respond to Notices, FantasyCraft Community aims to prioritize such communications due to their importance. Although we reserve our right to respond within three (3) days of receipt of a valid Notice, we endeavor, out of an abundance of caution and respect for intellectual property rights, to respond sooner where feasible.

  4. Miscellaneous: This document may be amended, modified, or replaced at any time at the discretion of FantasyCraft Community. It is the responsibility of the concerned parties to regularly review this procedure to remain informed of any changes.

Digital Millennium Copyright Act (DMCA) Notice and Counter Notice Procedures

 

DMCA Notice Requirements

Should you believe that any content on our platform infringes upon your copyrighted work, please submit a notice of claimed infringement containing the following:

  1. Identification of the Copyrighted Work: Clearly delineate the copyrighted work you believe has been infringed. This may be demonstrated via a link to the original work, a registration number, or any other specific point of reference.

  2. Identification of the Infringing Material: Provide a precise identification of the material you allege infringes upon the copyrighted work specified in item #1. This may be a URL or another exact location on our platform.

  3. Contact Information: Offer details that allow us to reach out to you. This should encompass your full name, postal address, phone number, and email address.

  4. Statement of Good Faith Belief: Append a statement expressing that you harbor a good faith belief that the contested use of the material is not sanctioned by the copyright proprietor, its agent, or the prevailing law.

  5. Statement of Accuracy: Attach a statement, vowing on the penalty of perjury, that the details provided in the notice are accurate and that you are either the copyright owner or authorized to act on their behalf.

  6. Signature: The notice must carry the signature of the copyright owner or an individual empowered to act on their behalf. In the digital realm, an electronic signature or a typed name is generally deemed adequate.

 

DMCA Counter-Notice Procedures

If you're of the opinion that a DMCA notice was served unjustly or in error, you reserve the right to dispatch a counter-notice. Such a counter-notice should encompass:

  1. Identification of the Material: Pinpoint the material that has been eradicated or to which access has been impeded, as well as where the material was situated prior to its removal or access curtailment.

  2. Statement of Good Faith Belief: Incorporate a statement, sworn under penalty of perjury, that you ascertain the material was removed or access was restricted either by mistake or due to a misidentification.

  3. Recipient's Contact Information: This should integrate your full name, address, telephone number, and a statement indicating your consent to the jurisdiction of the Federal District Court for your district, or if your address is extraneous to the U.S., for any judicial district where we may be located. Further, affirm that you will accept service of process from the individual who furnished the original DMCA notice or an agent representing them.

  4. Recipient's Signature: The counter-notice must bear your signature, be it physical or electronic.

 

Designated Agent

All DMCA notices and counter-notices must be directed to our designated agent via email at info@fantasycraftcommunity.com. It is imperative to note that communications sent through any other channel or platform will not be acknowledged for this purpose. A response will be provided within a maximum of three days, though it is our practice to address such critical matters more expeditiously.
