Governing Law

This Agreement and all related documents, and all matters arising out of or relating to this Agreement, whether sounding in contract, tort, or statute, are governed by, and construed in accordance with, the laws of Slovakia, without giving effect to its conflict of laws provisions.

Definitions

"Agreement" refers to the terms and conditions specified in this document and any other contractual obligations mutually agreed upon between the parties. "FantasyCraft Market" refers to the digital platform and its associated services.

Exclusive Jurisdiction

All disputes, controversies, or claims arising out of or in relation to this Agreement, including the validity, invalidity, breach, or termination thereof, shall be resolved by the competent courts of Slovakia. Parties to this agreement hereby submit to the exclusive jurisdiction of said courts for the purpose of any suit, action, or other proceeding arising out of this Agreement or any transaction contemplated hereby.

Consent

By using the FantasyCraft Market website and its associated services, both parties hereto expressly and irrevocably consent to the personal jurisdiction and venue of these courts. Both parties further agree not to challenge the jurisdiction or venue of said courts and acknowledge that they are not an inconvenient forum for resolving disputes arising from or related to this Agreement.

Alternative Dispute Resolution

Prior to initiating any legal proceedings, both parties agree to engage in good faith negotiations to resolve any disputes for a period of 30 days. If such disputes cannot be resolved through these negotiations, either party may then initiate legal proceedings.

Waiver of Trial by Jury

Both parties to this Agreement hereby waive any right to a trial by jury in any proceeding arising out of or related to this Agreement, whether now existing or hereafter arising and whether sounding in contract, tort, or otherwise. The parties agree that any of them may file a copy of this paragraph with any court as written evidence of the knowing, voluntary, and bargained-for agreement among the parties irrevocably to waive trial by jury, and that any dispute or controversy whatsoever between them shall instead be tried in a court of competent jurisdiction by a judge sitting without a jury.

Process Service

All notices, requests, claims, demands, and other communications concerning this Agreement shall be in writing and shall be deemed to have been given

(a) when delivered by hand (with written confirmation of receipt);

(b) when received by the addressee if sent by a nationally recognized overnight courier (receipt requested);

or (c) on the date sent by email to the addresses below, if sent during normal business hours of the recipient, and on the next business day if sent after normal business hours of the recipient:

Legal Fees

In the unfortunate event of any dispute arising out of this Agreement, the prevailing party shall be entitled to recover its reasonable attorney’s fees, court costs, and all other expenses, whether or not taxable by the court as costs, in addition to any other relief to which the prevailing party may be entitled.

Force Majeure

FantasyCraft Market is not liable for any delay or failure in performance resulting from causes beyond its reasonable control or unforeseen circumstances such as acts of nature, acts of government, flood, fire, earthquakes, civil unrest, acts of terror, strikes, or other labor problems, computer, telecommunication, internet service provider or hosting facility failures or delays involving hardware, software or power systems not within FantasyCraft Market’s possession or reasonable control, and denial of service attacks. Modifications to This Agreement

FantasyCraft Market reserves the right to revise and update this Agreement at any time. Any changes to this agreement will be communicated appropriately. By continuing to use the FantasyCraft Market website and its services after any revisions become effective, you agree to be bound by the revised Agreement.

Termination

FantasyCraft Market reserves the right to terminate this Agreement under specific conditions, including but not limited to breaches of this Agreement, and will provide adequate notice of such termination when feasible.
